Brian Stimson

Brian Stimson focuses his practice on complex litigation, trial and appellate advocacy, and investigations, primarily in the health care and telecommunications industries. He represents clients in commercial and business tort disputes, white collar criminal matters, regulatory litigation and consumer class actions.

Mr. Stimson is a vice-chair for the American Health Lawyers Association’s Payors, Plans, and Managed Care practice group, and a frequent lecturer on health care litigation issues.

Mr. Stimson earned his J.D., cum laude, from the University of Georgia School of Law in 2002. While at the University of Georgia, Mr. Stimson served on the Moot Court and Mock Trial Boards and was a pupil in the Henry Joseph Lumpkin Inn of Court. He also coached the Jerome Prince Evidence Law Moot Court Team to a national championship.

Before attending law school, Mr. Stimson worked as a press assistant for U.S. Senator Fred Thompson and was a legislative assistant with United Parcel Service’s Public Affairs division in Washington, D.C.

Representative Experience

  • Obtained a multimillion-dollar settlement as the lead counsel for a hospital chain in a payment dispute with the Medicaid managed care organization.
  • Defended a health insurer in arbitration with a dialysis services provider that alleged breaches of a national network contract.
  • Defended a hospital chain in a Medicare fraud investigation and a parallel state patients’ tort class action arising from the alleged performance of unauthorized medical procedures.
  • Defended a health insurer in a state attorney general’s investigation concerning the insurer’s physician and hospital ranking systems.
  • Sued to invalidate the state Certificate of Need regulation on behalf of a hospital chain.
  • Obtained a defense verdict in a jury trial of a cardiothoracic surgeon accused of abandoning a patient on the operating table.
  • Secured the dismissal of a qui tam action brought against a manufacturer under the federal False Claims and Buy American Acts.
  • Defended telecommunications service providers in a tort action involving alleged violations of the federal Wiretapping Act.
  • Persuaded the Court of Appeals of Georgia to affirm dismissal of speech tort claims against a publisher of telephone directories.
  • Obtained a grant of asylum from the U.S. Immigration Court in Atlanta for a Nepalese man tortured by Maoist insurgents for disagreeing with their communist and terrorist activities.
