Darren McCarty's practice focuses on commercial litigation, with an emphasis on complex financial disputes. Darren's background in public accounting and business consulting provides a unique perspective. He has represented some of the nation's largest corporations and most prestigious private firms in some of their most significant litigation.

Darren’s clients represent a variety of industries including technology, travel, telecommunications, energy, health care, public accounting, and insurance. He has represented directors, officers and other individuals in a number of actions. His litigation experience extends to securities, antitrust, accountant malpractice, banking, breach of contract, breach of fiduciary duty, tortious interference, cross-border disputes, RICO, non-compete and other employment agreements, real property, and insurance coverage and bad faith. Darren has also represented clients before both state and federal appellate courts.

Prior to beginning his law practice, Darren served as a law clerk to The Honorable Karen J. Williams of the United States Court of Appeals for the Fourth Circuit. Darren was formerly a CPA in the State of Texas, worked for a major accounting firm, and later as an international airline industry consultant.

Representative Experience

  • Defended a global energy and commodity company in two securities class actions related to the company's energy marketing and trading activities and its former telecommunications subsidiary.
  • Defended a travel holdings company against antitrust, RICO, and state law claims arising out of a successful Asian joint venture.
  • Defended a Mexico-based insurance company against bad faith and other claims by its insured, the world's largest producer of Mexican corn products. The matter related to the contamination of the nation's corn supply by genetically altered corn not approved for human consumption.
  • Defended a major semiconductor and electronics manufacturer in action arising out of a consumer telephone system development project.
  • Defended a Cayman Islands affiliate of a major accounting firm, its individual partners and Swiss verein, in a purported class action filed by Mexican investors concerning the audits of a San Antonio-based investment firm and a related off-shore bank.
  • Represented a U.S. hospital chain in related administrative and court proceedings to recover additional amounts for treating thousands of injured workers in the State of Texas.
  • Defended a wireless telecommunications provider against a former regional affiliate's substantial claims over an alleged improper termination of their affiliation agreement.
