H. Douglas Hinson

Doug Hinson is the leader of the firm’s ERISA Litigation Group. He has led the defense of numerous Fortune 500 clients in various types of ERISA class actions, including 401(k)/employer stock, benefit termination, defined benefit calculation and severance matters. In addition, Mr. Hinson has substantial experience and expertise in securities, complex commercial and insurance class action litigation.

Mr. Hinson’s practice is national in scope. He has been recognized as a “national leader” in ERISA litigation by Chambers USA America’s Leading Lawyers for Business, The Legal 500 and is listed in Who’s Who in American Law. Mr. Hinson is the chair-elect of the Employee Benefits Committee of the Tort and Insurance Practice Section and a member of the Joint Committee on Employee Benefits of the American Bar Association. He is a noted author and speaker on various topics related to ERISA and class action litigation, and he is on the editorial board of the Class Action Law Monitor.

Representative Experience

  • Served/serving as lead defense counsel in more than a dozen 401(k)/employer stock class actions, including matters in the Districts of Oregon, New Jersey, Maryland, Eastern Kentucky, Eastern North Carolina, and Middle Florida – winning five on motions to dismiss, defeating class certification in two and resolving all others before motions to dismiss were decided, three on terms that did not require monetary compensation to the settlement class.
  • Represented a major airline in multi-district ERISA class actions filed in Boston, Los Angeles, New York, Cincinnati, Albuquerque and East St. Louis pertaining to the actuarial value of lump sums and alleged cutbacks in pension benefits for active and retired pilots.
  • Led the defense of an international leader in the engineering and construction business in a severance pay class action litigated in the Eastern District of Pennsylvania.
  • Won summary judgment in the District of Kansas on behalf of a national real estate developer against putative class action ERISA claims brought by ESOP participants regarding acquisition of their employer.
  • Defeated class certification of fraud and breach of contract claims in the District of Indiana on behalf of a Fortune 500 insurance carrier.
  • Obtained partial dismissal and resulting favorable settlement terms for a national, diversified media company headquartered in Milwaukee in a class action filed in Wisconsin state court.
