Douglas G. Scribner

Doug Scribner is the co-chair of the firm's Litigation & Trial Practice Group, comprised of more than 180 attorneys from eight separate offices. He is a trial lawyer who specializes in complex commercial and insurance litigation in federal and state courts nationwide. As lead trial counsel, he has extensive experience representing Fortune 500 companies at trial, in arbitration and on appeal. He has been selected by his peers for inclusion in Super Lawyers magazine every year since its inception.

Mr. Scribner's national practice covers the full range of commercial disputes. He routinely represents corporate plaintiffs in commercial cases. Mr. Scribner also represents Japanese companies and their U.S. subsidiaries in litigation matters and is a founding member of the firm's Japan Business Practice Team. In addition, Mr. Scribner has represented as lead trial counsel both insurers and insureds in numerous litigation matters, involving virtually every line of insurance. As reflected below, he has served as lead trial counsel and tried to verdict numerous cases on behalf of Fortune 500 companies.

Representative Experience

Commercial

  • Lead trial counsel for a corporate plaintiff alleging theft of trade secrets and breach of contract, ultimately recovering $38 million, plus a sizable running royalty on all future sales.
  • Lead trial counsel for a corporate plaintiff alleging fraud and breach of contract, ultimately recovering more than $50 million, including all attorneys' fees.
  • Lead trial counsel for the defense in a case where the plaintiff sought to recover several hundred million dollars under various fraudulent conveyance theories. The case settled under favorable terms.
  • Lead trial counsel for a Japanese manufacturer that sought to recover more than $300 million from a U.S. supplier relating to product recall. The case settled under favorable terms.
  • Lead trial counsel for a Japanese electronics company in federal court in New York where the plaintiff sought to recover more than $30 million incurred in connection with a product recall issued by a U.S. automobile manufacturer. The case settled under favorable terms.

Insurance

  • Lead trial counsel for Safeco Insurance Company in the first “diminished value” class action case to go to trial in Washington federal court. The jury returned a defense verdict for Safeco on all counts.
  • Lead trial counsel for an international insurance company regarding a $43 million loss in which the insured sought coverage under a D&O policy for claims made under the Quo Warranto Act. This case of first impression settled on the eve of trial under favorable terms. 
  •  Lead trial counsel for a corporate plaintiff seeking damages from an insurer. The jury awarded the plaintiff all damages requested, including all attorneys' fees.

Products 

  • Lead trial counsel for the world's largest boat motor manufacturer in a case alleging that the manufacturer's defective design caused a running motor to be propelled into the boat and decapitate a passenger. The jury returned a defense verdict.
  • Lead trial counsel for the world's largest boat motor manufacturer in a federal court case alleging that the manufacturer's defective design caused the plaintiff to sustain severe and permanent spinal cord injuries. The jury returned a defense verdict.
  • Lead trial counsel for the world's largest boat motor manufacturer in a federal court wrongful death case alleging defective design and punitive damages. The case was dismissed prior to trial when the trial court excluded the plaintiffs' expert testimony based upon Daubert and spoliation of evidence. The trial court's decision was affirmed by the Eleventh Circuit.
