Payment Systems
Our retail and corporate payment systems attorneys have extensive experience in every aspect of traditional and emerging payment systems - from issuing and processing credit, debit and stored value cards and card transactions to ACH transactions, paper and electronic checks, person-to-person payment products and Internet-based bill payment platforms.
EXPERIENCE
We have assisted clients in breaking new ground in the payments arena, whether by obtaining key regulatory interpretations or clearances, developing program documentation, helping protect intellectual property rights, or negotiating product development arrangements, marketing alliances or joint ventures. We also have been active participants in the development of FDIC policy statements and regulations on the treatment of credit card and other securitizations in bank receiverships and conservatorships.
We have long advised payment industry participants in establishing and unwinding marketing and other alliances, including affinity and co-branded card arrangements and agent bank agreements, and have a rich history of advising payment industry participants in mergers and acquisitions, including purchases and sales of card and merchant portfolios and processors.
We are also a globally recognized counselor to the buyers of technology-related products and services. We have represented several different financial services clients in connection with their purchase of software licenses, implementation services and transaction processing services related to their credit card, debit card and point of sale operations.
RECOGNITION
We count among our group some of the most experienced financial institutions attorneys in the country including the former Deputy Chief Counsel for Business Transactions for the Office of Thrift Supervision and a co-chair of the ABA’s Committee on National Security and Defense.
