RESULTS

Alston & Bird’s trial lawyers have an outstanding track record representing our clients who have taken the offensive to protect their business rights and interests. On behalf of companies, entrepreneurs, and inventors, our trial lawyers have secured approximately two billion dollars in jury verdicts and settlements in recent years.

SCOPE

We have the resources to prosecute any case, from the most sophisticated financial fraud to the most complicated technical patents. As the list below demonstrates, our trial lawyers have represented clients as plaintiffs in virtually all areas of commercial practice, including antitrust, patent, copyright and trade secrets, commercial and financial fraud, baby FTC Act, technology and telecommunications, False Claims Act, products liability and contract.

As we do in other litigation matters, we embrace alternative fee arrangements when we represent our clients as plaintiffs. We routinely handle cases on full or partial contingency, or heavily discounted fees with results awards, or fixed fees with results awards.

RECENT VICTORIES

  • Represented MAN, a major German truck manufacturer, in fraudulent transfer case in Oregon state court, winning jury verdict of more than $1 billion, including $350 million in punitive damages. The National Law Journal featured the case as the largest jury verdict in 2006.

  • Represented Volumetrics Medical Imaging, a high-tech start-up company and pioneer in medical ultrasound, in suit alleging fraud and unfair and deceptive trade practices against an affiliate of Royal Philips Electronics in the Middle District of North Carolina, winning $318 million jury verdict (including a $45 million punitive damages award). The National Law Journal featured the case as the 6th largest jury verdict in 2003, and the victory was noted as the largest win for a plaintiff in the history of North Carolina. Subsequently represented VMI in patent lawsuits, winning a jury trial and securing substantial but confidential settlements from global corporations.

  • Represented the Enron Examiner in the Southern District of New York and, after reviewing tens of millions of documents and deposing scores of witnesses, identified approximately $7 billion in claims for the Enron estate.

  • Represented Twentieth Century Fox in copyright litigation against Warner Brothers over the rights to Watchmen, winning summary judgment that Fox owned the distribution rights to this major motion picture and securing very favorable settlement for our client.

  • Represented a major technology company in antitrust litigation in the Northern District of California, securing more than $200 million in settlements.

  • Represented client in the Central District of California in California False Claims Act and associated insurance litigation, securing $89 million settlement on behalf of our client.

  • Represented managing member of a residential portfolio business in New York state court in suit against minority members who ran the business day-to-day and had diverted mortgages from the business, winning several injunctions and 18-day and two other trials and recovering approximately $50 million in cash and other assets diverted from the business.

  • Represented client in negligent misrepresentation litigation in Georgia state court against accounting firm, securing a substantial, confidential settlement amount after $40 million jury verdict for our client.

  • Represented injured family in a products liability action in Eastern District of Virginia, asserting claims of negligence and breach of implied warranty of merchantability, and securing settlement of $20 million shortly after discovery began.

  • Represented Invesco Institutional against Deutsche Bank in cases in Kentucky and New York, winning preliminary injunctions to prevent former employees from joining Deutsche Bank and to prevent Deutsche Bank from using certain software tools designed to replicate parts of Invesco’s proprietary system. At the impending damages trial Invesco will seek approximately $80 million in lost profits as well as punitive damages.

  • Represented client in patent and trade secret case regarding optical fibers and related cable in the Northern District of Georgia, securing multi-million dollar settlement plus ongoing royalty payments.

  • Represented INEOS Fluor in patent infringement litigation in the Southern District of Texas and ITC, securing consent order injunction and eight-figure settlement.

  • Represented client in trade secrets litigation in Georgia state court against company founded by former employees. Case settled when our client acquired the defendant.

  • Represented client in art fraud litigation in the Southern District of New York, securing settlement worth $25 million.

  • Represented client in a fraudulent conveyance case, securing a settlement of $50 million, including attorneys’ fees.

  • Represented technology company in patent infringement lawsuit in the Central District of California, securing confidential settlements from numerous defendants.

  • Represented Emory University in construction defect litigation against a major builder developer, securing $7.5 million settlement for out client.

  • Represented major investment company in False Claims Act litigation, securing 8-figure settlement for the client.

  • Served as Chapter 11 Trustee of client in the Northern District of California, securing settlement of $24 million from hedge funds and law firm.

  • Represented client in professional negligence case in Georgia state court, winning jury verdict of $1.1 million.
