Alston & Bird LLP is pleased to provide this Seventh Edition of the Georgia Appellate Practice Handbook to the Institute of Continuing Legal Education in Georgia.

The Handbook was first published in 1985 under the leadership of Alston & Bird partner Terry Walsh, with the invaluable assistance of Supreme Court Justices Harold Clarke and George Carley (then a Court of Appeals Judge). The lawyers and judges who have contributed to updated editions of the Handbook during the intervening decades are too numerous to name, but we remain thankful for their contributions, leadership, and guidance in connection with this work.

On December 19, 2011, the Department of State’s Directorate of Defense Trade Controls (DDTC) published in the Federal Register (http://www.gpo.gov/fdsys/pkg/FR-2011-12-19/pdf/2011-32432.pdf) its proposed revisions to the brokering regulations set forth in Part 129 of the International Traffic in Arms Regulations (ITAR). The notice includes other proposed changes to Parts 122 and 129 that we anticipate will directly impact registration and other compliance requirements for most DDTCregistered parties, even those that have managed to avoid Part 129 activities in the past. If adopted as proposed, the new brokering rules would clearly apply to more parties involved (even indirectly) in defense trade transactions and require manufacturers and exporters of defense articles to pay closer attention to Part 129 requirements.

On December 15, 2011, the United States Congress approved the National Defense Authorization Act for Fiscal Year 2012 (H.R. 1540) (the “Act”), which contains, at Section 1245, new sanctions on Iran that potentially could bar a wide variety of non U.S. financial institutions from access to the U.S. banking system. The legislation is expected to be signed by the President. This advisory discusses those new sanctions.

In addition to announcing the voluntary recalls summarized in the Snapshot, the CPSC announced significant changes to the way it notifies manufacturers of complaints about their products. In the past, the CPSC mailed complaints to manufacturers; now, if a manufacturer has registered for the SaferProducts.gov database, it will receive both SaferProducts-eligible reports and reports not eligible for publication on the database electronically via a manufacturer-only tab on the database. The CPSC also announced that it is enhancing the Business Portal of the database so that businesses will eventually be able to add brand names for their products and the time periods during which they sold the products. These enhancements should lead to a reduction of manufacturer misidentification in reports published on the database.
