Alston & Bird Secures Jury Verdict Defeating Claims of Patent Infringement Against Nokia
Alston & Bird successfully defended Nokia of America Corp. against allegations that its router products infringed four patents owned by Smart Path Communications. On April 5, an Eastern District of Texas jury cleared Nokia of all claims of infringement, finding one patent not infringed, one patent invalid, and one patent invalid and not infringed. The Court held a fourth asserted patent not infringed and granted summary judgment prior to the trial. The result is that Nokia was found not liable on all four asserted patents.

This deal included raising over $14 million through a Regulation D offering and related stock purchase of Community Bank and Trust – Alabama. The transaction required the coordination and approval of multiple bank regulators and that the parties obtain a waiver of an FDIC-imposed cross-guarantee.
