In addition, we actively counsel clients regarding the emerging regulatory environment, including Regulation AB II and the Dodd-Frank Wall Street Reform and Consumer Protection Act. We also advise our clients on disputes and the administration of defaulted transactions. Our expertise and capabilities extend to all types of default scenarios, including those involving bankruptcy, litigation and the exercise of remedies by trustees. Our bankruptcy and litigation practices focus extensively on the representation of trustees and understand the issues and concerns trustees face in distressed transactions. We have represented corporate trust clients in complex bankruptcy and reorganization proceedings, including those involving Lehman Brothers, Capmark Financial Group, Inc., and Delta Funding Corporation. In addition, our litigators regularly advise clients both before and after litigation in connection with disputes involving issuers, bondholders, derivatives counterparties and other transaction participants. We have been at the forefront of structured finance defaults and litigation following the financial crisis and have become one of the top legal service providers to securitized trust trustees in connection with CDO litigation, the liquidation of CDO collateral, investor inquiries, RMBS servicer/originator bankruptcies and RMBS mortgage loan “put back” issues.
