Ken Weigel has 30 years of experience in advising companies on all aspects of international trade regulatory issues. His substantive areas of practice encompass import issues, export controls, international trade proceedings, trade policy and international agreements. Ken is recognized in the area of international trade and finance in The Best Lawyers in America.

In these areas, Ken provides counseling, represents companies in audits and investigations and assists in the creation and implementation of compliance programs. He regularly appears before numerous U.S. government agencies, including the U.S. Departments of Commerce (International Trade Administration and Bureau of Industry and Security) Justice, and State (Directorate of Defense Trade Controls), the U.S. International Trade Commission, U.S. Customs & Border Protection (CBP) and the Office of the United States Trade Representative. He also represents clients before the U.S. Supreme Court, the Court of Appeals for the Federal Circuit, the U.S. Court of International Trade and federal district courts.

Representative Experience

  • Representation of exporters before BIS and DDTC in disclosures and investigations.
  • Representation of a U.S. lumber importer in an action before the CIT and CAFC in successfully arguing for a "treatment" in the classification of its merchandise.
  • Representation of numerous companies in antidumping proceedings, including investigations, administrative reviews, sunset reviews and scope proceedings as well as duty assessment actions by CBP.
  • Representation of importers in CBP Compliance Assessment and Focused Assessment audits, drawback audits and NAFTA verifications by CBP.
  • Representation of companies in customs penalty and liquidated damages matters before CBP and the courts.
  • Representation of an industry group in assisting governmental authorities in a General Agreement on Tariff and Trade (GATT) dispute.
  • Assisted a foreign government in a World Customs Organization classification proceeding.
  • Representation in CJ proceedings before the DDTC.
  • Representation of companies in U.S. district court judicial proceedings arising out of international trade.
