Kristin Holloway Jones, an associate with the firm, focuses her practice in the climate change and carbon management arena, with a particular focus on advising clients regarding the development of carbon capture and storage (CCS) regulations in the United States and Canada, as well as the development and implementation of greenhouse gas emission regulatory schemes in the United States and abroad. She also represents clients in environmental enforcement actions and complex environmental and toxic tort litigation including federal and state enforcement actions, private party litigation and ADR, as well as internal compliance investigations stemming from enforcement actions. She has represented clients on these issues in both federal and state courts including courts in Georgia, Alabama, California, Louisiana, Massachusetts, Montana, New Jersey, New York, North Carolina and Pennsylvania. Her work has appeared in numerous publications including Bloomberg’s Sustainable Energy Law Report, BNA Environment Reporter, BNA Expert Evidence Report, Mealey’s Emerging Toxic Torts, Point Carbon and ABA publications.

Representative Experience

  • Advising several clients on emerging Federal schemes for greenhouse gas regulation.
  • On behalf of multiple clients, prepared and submitted public comments on several major U.S. EPA and state agency proposed rulemaking notices related to climate change issues, including U.S. EPA’s proposed Federal Requirements Under the Underground Injection Control Program for Carbon Dioxide Geologic Sequestration Wells, and Notice of Data Availability; proposed Mandatory Reporting of Greenhouse Gases Rule; and proposed Revisions to the Renewable Fuel Standard Program, as well as the California Air Resources Board’s proposed changes to its regulations for reducing greenhouse gases from heavy-duty vehicles.
  • Advising several clients on potential CCS regulatory schemes in the United States and Canada at both the federal and state/provincial levels.
  • Representing multiple clients in the defense of a $44 million CERCLA cost recovery claim at a former transformer repair site involving issues of “arranger” liability and the useful product defense.
  • Negotiated dismissal of three of four threatened claims in pre-enforcement action under CERCLA and EPCRA, as well as penalty less than 20% of potential statutory amount.
  • In resolving enforcement action alleging several dozen violations of TSCA; negotiated penalty less than half that originally sought.
  • Served as second chair in the defense of a $15.5 million CERCLA cost recovery claim at a former fertilizer manufacturing site involving statute of limitations, useful product, and NCP consistency issues, and negotiated settlement of claim.
  • Negotiated pre-litigation settlement of CERCLA cost recovery claims against leading world manufacturer of appliances and cleaning equipment.
  • Represented client in a 1200+ plaintiff case and related 30,000-member federal putative class action involving alleged toxic exposures in the mining industry.
  • On behalf of major worldwide transportation and logistics company, defended lawsuit and obtained successful settlement of claims against a jet fuel vendor related to a major spill in California.
