Mark T. Calloway is the leader of the firm’s Government Investigations and Compliance Group, and concentrates his practice in the areas of white collar criminal defense, internal corporate investigations, and compliance program development, implementation, and auditing. Immediately prior to joining Alston & Bird, Mark served for seven years as the United States Attorney for the Western District of North Carolina (February 1994 to March 2001). During his tenure with the Department of Justice, Mark also served as Director of the Executive Office for United States Attorneys in Washington, D.C., and as chair of the Attorney General’s Advisory Committee of United States Attorneys, and was a member of the Attorney General’s White Collar Crime Council.
Since 1993, Mark has held an AV Rating with Martindale Hubbell, has been listed in The Best Lawyers in America since 2005 and has been recognized by Super Lawyers magazine on multiple occassions. His peers in the legal community have selected Mark as one of North Carolina’s Legal Elite. A past chair of the Criminal Justice Section Council of the North Carolina Bar Association, Mark has also served as an advisor to the Ethics Committee of the North Carolina State Bar (1998-2000).

As Director of the Executive Office of the United States Attorneys, in Washington, D.C., Mark had responsibility for support and oversight of all 94 United States Attorneys Offices, and a key role in management and policy implementation for the Department of Justice. In January 2001, Attorney General Reno awarded Mark the Edmund J. Randolph Award for Outstanding Service to the Department of Justice. Prior to his service with the Department of Justice, Mark was a partner/shareholder in the law firm of James, McElroy & Diehl, P.A. in Charlotte, North Carolina. Prior to his association with James, McElroy & Diehl, Mark served as a research assistant to The Honorable Jack L. Cozort at the North Carolina Court of Appeals, and as a law clerk to The Honorable Robert D. Potter, then Chief United States District Judge for the Western District of North Carolina.
Mark received his undergraduate degree in political science from North Carolina State University in 1980. He received his J.D. degree in 1983 from Campbell University School of Law, where he was a member of the Campbell Law Review and the Trial Advocacy Team. Mark was admitted to the North Carolina State Bar in 1983. He is admitted to practice in the United States Supreme Court, Fourth Circuit Court of Appeals, North Carolina State Courts, Western District of North Carolina, Middle District of North Carolina, and Eastern District of North Carolina.
