Mr. Elgison has over 25 years of experience in intellectual property and technology matters and is the founder and former chair of Alston & Bird's nationally-ranked intellectual property practice. He has has served successfully as lead counsel in patent, trademark, copyright, trade dress, trade secret and false advertising litigation, as well as disputed matters involving computer software and other technology. He has also assisted clients in negotiating and structuring complex transactions involving technology and intellectual property rights, including information technology agreements, web-based and software agreements, trademark, copyright and rights of publicity license agreements, joint venture and joint development agreements, media broadcast and distribution agreements, sponsorship, marketing and promotional agreements, and publishing transactions. Mr. Elgison’s practice currently focuses on:

Representative Experience

  • Has represented NASCAR for more than fifteen (15) years in connection with domestic and international trademark protection and enforcement, development of its licensing program and restructuring of television and other media broadcast rights.
  • Has represented CARQUEST Corporation, one of the nation’s leading distributors of automotive parts and accessories, for more than twenty (20) years in connection with domestic and international trademark portfolio management and enforcement, information technology transactions, internet and other web-based transactions and general corporate matters.
  • Represents Wendy’s / Arby’s Group in connection with domestic and international trademark portfolio management and enforcement, marketing and promotional activities and other intellectual property matters.
  • Has represented the Estate of Bobby Jones, one of the world’s most famous athletes, for more than twenty-five (25) years in connection with management of the family’s licensing interests and protection of the name, image and trademarks domestically and internationally.
  • Represents Kids II, one of the nations leading manufacturers of infant toys and accessories, in connection with intellectual property counseling and enforcement as well as licensing and joint venture transactions.
  • Represented Grady Health System in connection with its procurement of a new enterprise software platform in a transaction valued at over $30 million.
  • Represented Atlanta Athletic Club in negotiation of its agreements with the PGA of America for the 2001 and 2011 PGA Championships, as well as other tournaments hosted by AAC. Mr. Elgison has also represented a private company in connection with its sponsorship of a charity event involving some of the PGA Tour’s highest profile golfers.
