Michael Young, partner in the firm’s Los Angeles office, has been a civil trial attorney for over 20 years with particular expertise trying and resolving employment, intellectual property and business disputes. Mr. Young’s employment litigation experience covers the panoply of employment conflicts, including claims of wrongful termination, sexual harassment, discrimination (including sex, race, disability, reverse discrimination and age), wage and hour (including class action defense), public policy violations and "whistleblower" matters. Mr. Young also supervises workplace investigations and counsels clients on numerous state and federal laws and regulations governing employment.

Mr. Young’s intellectual property practice includes disputes involving copyrights, trademarks, trade secrets, non-competes and other restrictive covenants, patents, and more. He has been recognized by his peers as a "Super Lawyer" in Intellectual Property since 2005, and serves on the Executive Committee of the USC IP Institute. Mr. Young writes often on employment and IP issues, and is a featured blogger on IP ADR topics at www.ipadrblog.com.

Representative Experience

  • Represented telecommunication client in class action claiming independent contractors should have been classified as employees. Defeated class certification.
  • Represented advertising company in bringing claims against former senior officers for misappropriating trade secrets, diverting corporate opportunities, hacking into computer system, and other unlawful acts. Ultimately obtained permanent injunction and sizeable judgment against officers.
  • Represented countless employers in defense of all manner of workplace-based claims, including harassment, discrimination, disability, retaliation, whistleblowers, etc.
  • Represented heavy equipment manufacturer in claims against former employees who had stolen client's trade secrets and were manufacturing counterfeit replacement parts in Texas and other states. Cooperated with U.S. Attorney to bring criminal charges against some under Economic Espionage Act, resulting in prison sentences and restitution orders of several million dollars. Stipulated judgments were obtained against others.
  • Obtained ex parte seizure orders, and coordinated simultaneous surprise raids on each coast by law enforcement, to seize counterfeit goods and shut down unlawfully competitive operations.
  • Defended financial institution against claims that its hiring of competitor's employees resulted in the violation of non-compete and non-solicitation agreements. Prevailed in FINRA arbitration, defeating effort to obtain injunction.
  • Defended major manufacturer against claims of copyright infringement arising out of the use of certain competitive literature. Settled for less than the plaintiff's attorneys’ fees.
  • Lead counsel in two month jury trial on behalf of plaintiff, alleging unfair competition and insurance bad faith. Obtained jury verdict on all claims, including award of punitive damages.
  • With Mr. Rochefort and Mr. Roux, successfully defended major oil company in a four month jury trial involving claims arising out of the construction of a major oil processing facility.
