Sayaka Karitani is a senior associate in the firm’s Labor & Employment Group. Her practice encompasses various types of employment litigation, including wage and hour class action, discrimination, wrongful termination, retaliation, misappropriation of trade secrets and unfair competition matters. She also advises employers on personnel policies and procedures, employee handbooks, employee discipline matters and wage and hour compliance. She has defended clients in federal and California courts, as well as before the California Department of Fair Employment and Housing.
Sayaka also has experience litigating complex business disputes, including franchise, contract and securities fraud matters.
Sayaka has coached the Loyola Law School National Moot Court Competition Team for the last several years. Two members of her teams have received the “best oralist” title at the regional competition, and one of her teams finished second overall in the region.
Sayaka received her J.D. from Loyola Law School, Los Angeles, in 2005, and her B.A. from Cornell University in 1995.

This advisory discusses the background and implications of the September 7, 2012, decision by the National Labor Relations Board (NLRB or the “Board”) that held that an employer’s social media policy prohibiting statements that “damage the Company, defame any individual or damage any person’s reputation” violated the National Labor Relations Act (NLRA) and that employees would reasonably construe the policy to restrict certain protected concerted activities, namely communications, regarding the employer’s treatment of its employees.
