Chuck Gartland is a partner in the firm’s Labor & Employment Group who focuses his practice on employment litigation and counseling. He has successfully defended employers in a broad range of individual and nationwide class action matters, including wage-and-hour litigation under the Fair Labor Standards Act and state law, and all varieties of claims for employment discrimination and retaliation. Chuck also has substantial experience litigating cases involving misappropriation of trade secrets and confidential business information, violation of non-competition and other restrictive covenants, and related customer and employee raiding claims. In addition, Chuck regularly counsels clients on compliance with employment statutes such as the Family and Medical Leave Act and its state-law counterparts.
Chuck earned his J.D. from the University of Virginia School of Law, where he was a member of the Order of the Coif and a finalist in the Lile Moot Court Competition. Chuck received his B.A., cum laude, from Villanova University, where he was a member of the honors program. Prior to joining Alston & Bird, Chuck served as a law clerk for the Honorable William S. Duffey, Jr. of the United States District Court for the Northern District of Georgia.
- Lead counsel in obtaining summary judgment on behalf of a worldwide transportation and logistics company in numerous employment discrimination and retaliation lawsuits, including cases involving claims under Title VII, the ADEA, the ADA, the FMLA and a variety of state-law claims.
- Served as primary outside counsel for a nationwide transportation services company with respect to all employment litigation matters and counseling on a wide range of employment issues, including reduction-in-force planning and WARN Act compliance.
- Defeated class certification in FLSA-based “call center” overtime cases filed against a national telecommunications company.
- Successfully defended putative FLSA collective action brought against a national facilities management company accused of violating laws relating to overtime.
- Obtained pre-hearing dismissal of an arbitration proceeding involving claims for national origin discrimination and retaliation against a national bakery company.
- Successfully prosecuted TRO and preliminary injunction action against a competitor attempting a “liftout” in the financial services industry.
- Obtained an appellate reversal of a trial court decision certifying a class of current and former employees with respect to claims against a national telecommunications company for alleged unlawful pay practices.
- Won affirmance of summary judgment and other pretrial dismissals in federal appellate proceedings in the Fourth, Sixth and Eleventh Circuits.
