Darren McCarty's practice focuses on complex commercial litigation, securities litigation, class action litigation, and appellate matters, including First Amendment issues. He regularly serves as lead counsel in appeals before both state and federal appellate courts. Darren has represented clients engaged in a variety of industries, including telecommunications, automotive, financial services, insurance, health care, travel services and public accounting.
Darren began his career as a CPA with a Big Four accounting firm and then served as a business consultant to a number of international airlines, assisting them with route planning, traffic management, feasibility studies and structuring financial operations.
Prior to beginning a private practice, Darren was a law clerk to The Honorable Karen J. Williams, former Chief Judge of the United States Court of Appeals for the Fourth Circuit. In 1998, he received his J.D. from the William & Mary School of Law, where he served as the editor-in-chief of the William and Mary Law Review and was elected to the Order of the Coif. He received his B.B.A. in accounting from the University of Texas in 1989.
- Defended a global energy company in two securities class actions related to the company's energy marketing and trading activities and its former telecommunications subsidiary.
- Defended a global automobile manufacturer in multidistrict litigation involving hundreds of consolidated class actions arising from a highly-publicized product recall and other claimed defects allegedly resulting in monetary loss to the plaintiffs.
- Represented an organization of over 2500 municipalities as amicus curiae before the United States Supreme Court regarding a First Amendment issue of substantial importance to local governments.
- Defended a Mexico-based insurance company against bad faith and other claims by its insured, the world's largest producer of Mexican corn products. The matter related to the contamination of the United States’ corn supply by genetically modified corn not approved for human consumption.
- Represented a U.S. hospital chain in related administrative and court proceedings to recover additional amounts for treating thousands of injured workers in the state of Texas.
- Represented financial institutions in disputes involving statutory lending practices and secured lending.
- Defended a Cayman Islands affiliate of a major accounting firm, its individual partners and Swiss Verein, in a purported class action filed by Mexican investors concerning the audits of a Texas-based investment firm and a related off-shore bank.
- Defended a travel holdings company against antitrust, RICO and state law claims made by a major competitor arising out of a successful Asian joint venture.
- Defended a wireless telecommunications provider against a former regional affiliate's substantial claims over an allegedly improper termination of their affiliation agreement.
