Andy Howard represents clients across the construction, health care, aerospace, defense, energy, manufacturing, and technology sectors in contested and transactional matters. His practice spans major private developments and public works projects, as well as federal, state, and local government contracts.
In his construction practice, Andy represents developers and large general contractors in complex litigation and arbitration involving extra work, defective work and design, delay, disruption, productivity loss, scheduling, payment, and other claims. He also negotiates and drafts sophisticated construction agreements and related project documents with a focus on clear risk allocation and claims prevention.
In his government contracts practice, Andy advises companies on the Federal Acquisition Regulation (FAR), agency supplemental regulations, and comparable state procurement rules. His counseling includes contract formation and performance, subcontracting and consent requirements, domestic source restrictions, classified information, and protection of trade secrets and other proprietary information under FOIA and state public records laws.
Andy represents companies in pre- and post-award bid protests and other adversarial proceedings involving government agencies, at the federal, state and local levels including Contract Disputes Act and Government Code Government Code claims, Administrative Procedure Act challenges, False Claims Act investigations and reinvestigations and related litigation, and suspension and debarment matters.
