Mr. Solomon’s practice encompasses a wide scope of financial transactions and their resolution. He regularly represents lenders and borrowers in the origination of debt financings, including commercial real estate backed loans, asset-based loans and syndicated loans. In addition to his representation of lenders and borrowers, Mr. Solomon regularly counsels trustees, agents and servicers in connection with securitizations, high-yield debt transactions, project finance, municipal and corporate bonds, and other finance structures.
Of equal importance to Mr. Solomon’s practice is his work in distressed situations. He regularly represents lenders, trustees and borrowers in connection with workouts, pre-bankruptcy restructurings and bankruptcy cases. His broad-based experience on the “front end” of transactions gives him unique insight into many of the underlying decision points that become relevant when transactions become troubled. He has spent significant time over the last several years representing various parties in connection with workouts, restructurings and bankruptcies in the senior living space, specifically continuing care retirement communities.
Prior to moving to Charlotte, Mr. Solomon practiced in Delaware where he is admitted to practice. While in Delaware, he gained particular expertise in the use of Delaware statutory trusts, limited liability companies and other alternative entities.
- Represented an administrative agent for a senior lender group in In Re Erickson Retirement Communities, LLC.
- Counsel to a major sports entity in connection with the formation and ongoing administration of a statutory trust involved in licensing intellectual property.
- Represented a trustee on second lien notes in In Re Nebraska Book Co., Inc.
- Represented a trustee on various trust-preferred transactions in connection with bankruptcies and receiverships affecting the related bank holding company or bank subsidiary.
- Counsel to a senior lender in a multi-tiered financing relating to the acquisition, aggregation and development of approximately 50 marina-related properties in south Florida.
