Mark T. Calloway, immediate past leader of the firm’s Government Investigations & Compliance Group, concentrates his practice on white collar criminal defense, with an emphasis on health care, internal corporate investigations, compliance program development, implementation and auditing. Prior to joining Alston & Bird, Mark served as the United States Attorney for the Western District of North Carolina from 1994 to 2001. During his tenure with the Department of Justice, Mark also served as director of the Executive Office for United States Attorneys in Washington, D.C. and was responsible for support and oversight of all 94 United States Attorneys’ Offices, and played a key role in management and policy implementation for the Department of Justice. He also served as chair of the Attorney General’s White Collar Crime Council.
In 2001, Attorney General Reno awarded Mark the Edmund J. Randolph Award for outstanding service to the Department of Justice. Mark has held an AV Rating with Martindale Hubbell since 1993; he has been listed in The Best Lawyers in America since 2005 and has been recognized by Super Lawyers magazine on multiple occasions. His peers in the legal community have selected Mark as one of North Carolina’s Legal Elite.
- Lead counsel for a major energy company during a year-long federal grand jury investigation into the propriety of certain accounting treatments in its filings with state regulatory commissions. Obtained a letter from the Department of Justice clearing the company of any criminal wrongdoing.
- Co-trial counsel for an accountant charged with 35 federal felonies. After a five-week trial, the jury found the accountant not guilty of all charges.
- Successfully represented a former assistant sales manager for a major polyester staple fiber manufacturer in a federal criminal antitrust trial. After a week-long trial, the federal jury acquitted the client of any wrongdoing.
- Outside compliance counsel to one of the leading chemical, plastics and agricultural products and services companies in the world.
- Outside counsel to a world leader in quality dialysis products and services.
