Mike Johnson, a partner in the Litigation & Trial Practice Group, has represented a variety of business and individual clients in complex commercial disputes. Mike’s practice has focused on financial services litigation, structured finance and derivatives disputes, complex business litigation, employment-related disputes (particularly restrictive covenant litigation), securities class actions and international arbitrations. His experience includes multiple trials and arbitrations, as well as state and federal appellate work. Mike has appeared in courts and before arbitration tribunals in New York and throughout the United States, and he has authored articles on international arbitration and class action practice that have appeared in regional and national publications, including The National Law Journal.
- Represented several trustees in litigation arising from disputes over collateralized debt obligation (CDO) transactions, mortgage-and other asset-backed securities (MBS and ABS) and credit default swaps (CDS).
- Pursued a mediation claim against a financial guaranty insurer on behalf of an underwriter and investor in a synthetic CDO transaction arising from nine-digit CDS exposure.
- Represented several financial institutions, as trustees and in other roles, in a monoline insurance company rehabilitation proceeding.
- Pursued federal court litigation on behalf of a large, generic pharmaceutical company for breach of a patent license agreement.
- Defended an international professional services firm accused of misappropriating business in connection with its hiring of a senior executive from a competitor.
- Represented a major European telecommunications company in an international arbitration brought by its U.S. sales agent.
- Won confirmation of an international arbitration award in excess of $35 million against a European government instrumentality that sought to avoid enforcement on jurisdictional and sovereign immunity grounds.
- Prosecuted a copyright infringement action on behalf of an international software manufacturer, including federal court jury trial and appeal.
