Richard Giller has over 25 years of experience as a litigator, with an emphasis on insurance litigation and insurance coverage. He has litigated, analyzed and opined on the meaning of most standard commercial insurance policy provisions. He has examined a wide variety of insurance policy forms, including CGL, D&O, EPLI and professional liability policies. He has also worked on cases involving title insurance, umbrella and excess policies, and environmental liability insurance. Mr. Giller has also been involved in a number of construction cases involving insurance products, such as wrap-up, OCIP and CCIP policies. He has substantial experience in litigating insurance coverage issues on a myriad of complex issues and has been involved in a number of significant appellate court decisions involving important insurance issues. Mr. Giller has extensive experience with continuous injury cases, such as environmental exposures, toxic mold and asbestos coverage issues, as well as with successor liability issues in insurance cases. He has tried a number of state and federal insurance coverage cases and has substantial arbitration and mediation experience involving insurance coverage.
- Prosecution, defense and trial of claims under liability, property, professional liability, employers’ liability, business interruption and title insurance policies.
- Successfully resolved, through alternative dispute resolution mechanisms, dozens of insurance cases involving asbestos claims, construction defect disputes, environmental contamination cases, additional insured exposures and other issues.
- Appeared as amicus curiae before the California Supreme Court in two cases concerning the following insurance issues: (1) what types of legal proceedings trigger an insurance company’s duty to defend any “suit” under a standard comprehensive general liability (CGL) insurance policy and (2) whether certain insurance policy language was broad enough to include coverage for the liability of environmental cleanup and response costs ordered by an administrative agency.
- Obtained summary judgment, affirmation of that judgment on appeal and, ultimately, judgment and settlement in excess of nine figures on behalf of a product manufacturer in litigation arising out of a California False Claims Act action brought on behalf of over 100 municipal entities and in related common law fraud action.
- Successfully represented the respondent in a California Court of Appeals case deciding the extent to which confidential communications between an insurance company’s employees regarding legal advice and strategy were protected from disclosure during discovery.
- Defense of toxic and mass tort actions.
- Successfully appealed to the Seventh Circuit Court of Appeal overturning a ruling from the U.S. District Court for the Northern District of Illinois concerning the preclusive effect of a state court judgment on the duty to defend with respect to arbitration issues relating to peripheral deductible agreements filed in district court in Illinois.
