This advisory discusses the Treasury’s 2011-2012 Priority Guidance Plan. Under the plan’s consolidated return and corporate headings are several previously issued proposed and temporary regulations dealing with perennial detailed issues under Sections 358, 355 and 382 and consolidated return favorites that include “agent of the group” and the loss disallowance rule.
There are many items in the plan of potential interest to segments of taxpayers on the business plan, which items have a way of resulting in proposals—if not this year, then later. The problem for taxpayers interested in weighing in is knowing whether an item has any immediacy. Examples are included in the advisory.

The Affordable Care Act (ACA) provides for a State-based transitional reinsurance program to help stabilize premiums for coverage in the individual health insurance market during the first three years of operation of the Exchanges (2014-2016). The program is designed primarily to transfer risk from the group market to the individual market. The program is funded through “contributions” from fully insured and self-insured plans. The statute sets forth the aggregate amount to be collected—$12 billion in 2014, $8 billion in 2015 and $5 billion in 2015. The aggregate amount is divided among plans subject to the fee as provided by the Department of Health and Human Services (HHS).

This advisory discusses the U.S. Supreme Court’s unanimous decision in Mayo Collaborative Services, et al. v. Prometheus Laboratories, Inc., which reversed the Federal Circuit and held that Prometheus Laboratories, Inc.’s (“Prometheus”) personalized medicine dosing processes were ineligible for patent protection under 35 U.S.C. § 101. The Court held that “[i]f a law of nature is not patentable, then neither is a process reciting a law of nature, unless that process has additional features that provide practical assurance that the process is more than a drafting effort designed to monopolize the law of nature itself.” Slip Op., at 8-9. The Court ruled that Prometheus’s processes were directed essentially to laws of nature, and the claims did not add enough to qualify them as patent-eligible processes that apply natural laws.

February might be the shortest month of the year, but that did not stop the CPSC from announcing more recalls in February than any other month over the past six months — 35 recalls to be exact. In addition, February was the first time in the past six months that child/infant products were not the most frequently recalled product category. That distinction went to housewares, which had nine recalls last month. Over the past six months, housewares have averaged 2 – 4 recalls per month, making the nine recalls in February a significant increase in the monthly average for housewares recalls. Below is a table displaying the total number of recalls announced by the CPSC in each product category over the past six months.
