What Employers Need to Know about the EEOC's Final GINA Regulations
On November 9, 2010, the EEOC issued its interim final regulations on the employment related provisions in Title II of the Genetic Information Nondiscrimination Act (GINA). The Title II regulations are effective January 10, 2011. These Title II regulations, which follow on the heels of the Title I regulations issued last year regarding group health plans, address the scope of "genetic information" covered by the statute, the extent to which employers may request or require genetic information from employees, and employers' confidentiality obligations with respect to covered genetic information. The presentation will discuss the key points of the new regulations and discuss steps that employers should take to ensure compliance with GINA.
Electronic Privacy Rights in the Workplace
It continues to be a challenge to balance the competing interests of corporate America and those of its employees when it comes to the subject of electronic communication. Employees, rightly or wrongly, often believe they have a privacy right in cyberspace that should not be limited or infringed, even by their employer. We will provide an update on the most recent rulings by the U.S. Supreme Court on employee privacy rights, as well as decisions from other courts and a review of proposed legislation.
