John Doherty and Paul Donohue presented, "Understanding and Preventing Liability in Servicing," during the General Session on May 18, 8:30am - 9:30am, at this conference sponsored by the Mortgage Bankers Association MBA). Understanding how actions taken by servicers can result in liability is one of the components of a servicer’s risk management plan. In this session, panelists exposed some common traps that can result in servicer liability. From the contents of email communication and non-compliance with loan document terms to failure to respond to requests, practices to be avoided will be highlighted as well as how routine servicing practices and/or communication can be misinterpreted in litigation.
