As reported in Law360, a U.S. International Trade Commission judge has upheld his earlier finding that a Chinese chemicals company violated Section 337 by importing refrigerants that infringed our client INEOS Fluor Holdings Ltd.’s patent covering a manufacturing process for an environmentally-friendly coolant. In a remand determination, the judge reaffirmed the validity of the patent and recommended a limited exclusion order barring the infringing coolants from entering the United States.
The Commission has until June 1, 2009, to decide whether to implement the judge's recommendation.
