Partner Andy Howard was quoted in a Law360 article discussing federal efforts to block counterfeit parts from making their way into the U.S. defense supply chain. Howard noted that more DOD guidance would be helpful: “If the various components in the defense supply chain lack a uniform understanding or definition of what a counterfeit product is, then there can be no uniform protocol or practice in place to address that problem,” he said.
Howard also noted that contractors agree with defense agencies that counterfeits are an ongoing problem. “It isn’t a lack of understand, it’s more a lack of focus that has been paid to the issue,” he said. “The publicity for the problem, and the light being shined on it by the administration, is going to have an effect going down the chain, to make sure the products getting into the supply chain are what they’re represented to be.”
