Lee DeHihns III was quoted in a FOXNEWS.com article discussing environmentalists’ use of litigation to combat global warming. “People have a right to sue for redress of grievances,” said DeHihns, whose firm is consulting with defendants in these types of cases, equating global warming with the concept of “public nuisance.” “You can sue for an intentional infliction of harm, a nuisance.”
DeHihns continued: “If nasty water runs from my yard into your yard, it is a trespass. It’s an act against your property.” Environmentalists, he pointed out, “are seeking to have the court impose more control over companies than the statute imposes.”
