Larry Jones was quoted in a Law360 article discussing his representation of GoldToeMoretz in a trademark dispute with Columbia Sportswear. Columbia has sued the client, seeking a ruling that a geometric design on its women’s hiking socks does not infringe on GoldToeMortez’s patented design. The suit comes as a response to a cease-and-desist letter from the client.
Jones noted that the lawsuit was filed despite his offer to extend a deadline for Columbia to hand over sales information, before invoking formal discovery procedures. “In order to evaluate the claim, we need to know how much has been sold,” Jones said. “It is not sufficient for an infringer to say we’ll stop infringing when we’ve sold everything.”
