Across the country, state AGs use their investigative and prosecutorial powers to bring cases under consumer, antitrust, environmental, health care, financial services and cybersecurity and privacy laws. Businesses are increasingly facing multistate AG investigations and investigations in which state AGs work closely and cooperate with federal agencies (like the Federal Trade Commission or the Federal Communications Commission). State AGs tout their eight- and nine-figure recoveries against entities with no end in sight. This growth in state enforcement—both at the individual state and multistate levels—underscores the need to retain outside counsel with substantial experience and repeat at bats dealing with these authorities and in-depth insider knowledge of how the agencies operate.
