Not only are tax-exempt organizations subject to complex federal, state and local laws and regulations, but there are limitations as well on the extent to which certain exempt organizations can influence and participate in the development of informed public policy. A section 501(c)(3) organization, for example, can lose its tax-exempt status if it engages in too much lobbying or legislative activity. A section 501(c)(3) organization can also lose its tax-exempt status if it engages in any political activities.

In advising our exempt organization clients on their advocacy efforts, we work hard to eliminate the widespread misconceptions about relevant rules that have restricted the legitimate public policy activities of charitable organizations. Rather than steering our exempt organization clients away from advocacy, policy and legislative activities, we help our clients understand that, if properly conducted, lobbying can be a legitimate, encouraged and protected activity.

Whether or not they are engaged in legislative or lobbying activities, we advise our exempt organization clients on all federal, state and local laws and regulations that are relevant to them. In addition, our lawyers monitor and evaluate pending legislation on behalf of our exempt organization clients and, where appropriate, we intervene in the legislative or policymaking process. On a number of occasions, we have actually drafted legislation for our exempt organization clients and shepherded that legislation through the legislative process. Whatever legislative or policymaking needs or interests an exempt organization may have, we have both the expertise and the hands-on experience to serve those needs and interests.
