FMLA Update: Recent Developments, Changes for Military Families, and Hot Topics for 2010 - It has been a year since the Department of Labor's revised FMLA regulations went into effect in January 2009. Since that time, employers covered by the FMLA struggled with several key changes, including changes to the employer-notice requirements and medical certification process, rules relating to substitution of paid leave, permissible calculations of intermittent and reduced schedule leave, the permissibility of certain bonuses, and the impact of light duty work. In this presentation, we will explore the most common FMLA issues that employers face under the revised regulations and provide practical advice for navigating these challenges. We will also provide a comprehensive overview of the family military leave provisions that were implemented through the revised regulations, including the October 2009 expansion of both types of family military leave. Finally, we will discuss recent legislative initiatives to further expand the FMLA in the future.
