When the Supreme Court struck down the Defense of Marriage Act, the definition of spouse under the Internal Revenue Code changed, creating a ripple effect through employee benefit plans. The Court’s recent decision not to take up appeals from lower courts on same-sex marriage bans further changes the legal landscape in states across the country. The panelists discussed the impact of these recent Court decisions on employee benefit plans and other aspects of the employment relationship and explored practical options employers have for dealing with the changes.
