Clark Calhoun was a featured speaker during this webinar program hosted by Institute for Professionals in Taxation (IPT). The Due Process Clause has long taken a back seat to the Commerce Clause in challenges to a state's ability to assert jurisdiction over and impose taxation against a multistate taxpayer. However, in recent years, the Supreme Court and others have breathed life back into the Due Process Clause, and it is now a viable defense against a state's aggressive assessments. This session provided an overview of Due Process analysis to date, with a focus on the U.S. Supreme Court cases addressing the Due Process Clause and the state tax cases that have applied the Due Process Clause to negate the state's taxing authority.
