On Wednesday, May 11, President Obama signed the Defend Trade Secrets Act of 2016 (DTSA) into law. The DTSA, which received rare support across party lines, creates a federal private right of action for misappropriation of trade secrets under the Economic Espionage Act, allowing for the development of a uniform national case law. Employment and intellectual property are the two key contexts in business today under which trade secret issues can arise.
