Debbie Cazan and John Spangler will be speaking on this two-part webinar series presented by Alston & Bird and FTI Consulting.

Contractors across the U.S. are all feeling the effects of COVID-19 on their pocketbook, their progress, and their schedule on ongoing and scheduled construction projects. We are in truly unique and unchartered territory, with many questions that need to be addressed.

This two-part webinar series will address questions such as:

  • How do contracts address something like COVID-19, and what happens if your contract does not address a pandemic like COVID-19? Is it:
    • A force majeure event
    • A suspension of work
    • A change in law
    • An unforeseeable circumstance
    • A national emergency
  • Can you receive a time extension for the effect of any shutdown, suspension, or slowdown of field operations?
  • Can you receive compensation for the time extension/protraction and inefficiency impacts, or is the best-case scenario time but no money?
  • If you can recover from the pandemic, what are the best ways to document and quantify the impacts on cost and time?
  • What responsibilities do contractors have to mitigate the impact of COVID-19 issues?
  • If your project is not stopped, but you are going slower due to supply chain issues, increased worker absenteeism, requirements to reduce labor congestion, or other impacts, how do you establish that the disruptions and inefficiencies are directly tied to COVID-19 issues (and not concurrent with other issues), and how do you quantify those the impacts on cost and time?
  • How do we see private owners, public agencies, and insurers approaching these issues on current projects, and how are they planning for them on future projects?
