The September 13, 2001 issue of the Fulton County Daily Report published the article, "Judge Raps Ex-Bar President for IV Tactic During Closing." The article references the case, Alphamed v. B. Braun Medical, No. 1:98-CV-1360 (N.D. Ga.Aug 2, 2001), in which Kip Kirkpatrick represents the defendant B. Braun Medical. They were getting sued by Alphamed for demanding its deposit back when the medical pumps Alphamed manufactures were recalled.
Opposing counsel inserted an IV needle into a vein in his arm and hooked the IV to a medical pump manufactured by his client. Kip was quoted as saying, "we had no forewarning of what he was going to do." The court had recently awarded Alphamed Inc., $4.4 million in damages for breach of contract. The verdict was tossed out by the judge and B. Braun Medical Inc. received $2 million.
