John Hickman, David Benoit, and Amy Heppner are co-authors of
“Final HIPAA Privacy Regulation Modifications: What Plan Sponsors Need to Know,” appearing in the October 2002 issue of Benefits & Compensation Law Alert. On August 14, 2002, HHS issued its long-anticipated modifications to the final December 2000 Health Insurance Portability and Accountability Act (HIPAA) privacy regulations. There are few surprises from the modifications HHS first proposed in March 2002. Nevertheless, the interpretive preamble to the Modifications includes important clarification for group health plans and plan sponsors relating to the status of enrollment information as protected health information (PHI) subject to HIPAA, health plan underwriting, and rules for sharing PHI with other health plans.
