Adam Biegel was quoted in a Global Competition Review article discussing the dismissal of an FTC complaint filed in federal court challenging a merger between two rival hospitals in Georgia. The court found that the state hospital authority and other actors qualified for immunity from the relevant federal antitrust laws. Biegel noted that such antitrust issues are complex, and require care due to the statutes, parties and activities involved. “While this decision is a setback for the FTC and provides another data point for interpreting the relevant state laws and activities here, it is unlikely to diminish the need for careful consideration of a variety of immunity issues in future transactions across the country,” he said.
