California Gov. Jerry Brown has proposed Trailer Bill 831 as part of the state’s budget process for dealing with the drought but what critics say is an attempt to exclude public works projects from the California Environmental Quality Act (CEQA).
Ed Casey, partner with Alston & Bird and co-head of its Land Use Practice who works with developers on CEQA matters, said he doesn’t think the trailer bill creates a broad CEQA exemption.
“This is for very specific directives that [the governor] identified in his very specific proclamation of emergency,” Casey said.
