The Foreign Corrupt Practices Act (FCPA) should be on the minds of hedge funds managers and other alternative investment professionals, as its enforcement is becoming stricter and is expanding into areas outside those traditionally involving a direct encounter with a foreign official. As a result, all overseas investments need to be carefully assessed for FCPA risks. A well-planned and implemented anti-corruption program can help avoid monetary penalties, potential government investigation and a damaged reputation. Attendees learned about the pitfalls that hedge fund and private equity managers may confront, as well as how to identify and minimize those risks.
