Debbie Jones spoke on the panel “Key Takeaways from the Emerging State Developments and Trends in Mortgage Servicing Litigation” at the 26th National Forum on Residential Mortgage Regulatory Enforcement & Litigation conference sponsored by the American Conference Institute.

This panel discussed regional updates on state law and litigation in California, New York, the Southeast, and the Midwest; loss mitigation activity in key states; what claims are valid by a borrower if homeowner modification is denied; and current MERS litigation on issues regarding recorded mortgages. The panel provided an update on statute of limitations challenges relative to determining date of breach, foreclosure nuances, and default notices in key states.
