Joey Burby will speak on the panel “A New Frontier: DOJ Enforcement Involving Health IT” at this program sponsored by the American Health Law Association.
This panel will discuss the federal government’s Electronic Health Record (EHR) Incentive Program a/k/a “Meaningful Use” and how the Department of Justice (DOJ) is using the program to pursue alleged False Claims Act (FCA) violations against participating EHR vendors and providers. The panel will discuss the DOJ’s various theories of FCA liability (including liability premised on alleged violations of the Anti-Kickback Statute), potential defense and litigation strategies, and compliance advice. Additionally, the panel will discuss recent major settlements and other ongoing FCA cases involving EHR vendors and providers.
