Anna Nolan will be a panelist on “Megatrends in France, Germany, Poland, and the UK – Harmonization of Insolvency Laws or Continuation of Forum Shopping?” where they will discuss The European Commission’s proposal for a directive aimed at harmonizing insolvency law in the EU. Creditors' quick and meaningful recovery is a key goal of the EC agenda. The proposal focuses on, among others, “pre-pack” sales (including credit bidding), and insolvency claw-back actions.
Panelists will consider if the proposal is a welcome development at the EU level or at odds with currently well-functioning domestic insolvency legislation in EU member states. The discussion will also cover creditors' protection in the UK and the case study of the Adler Restructuring Plan.
