Tom Crocker was quoted in The Journal of Commerce, in an article discussing recent reform to the processes of the Committee on Foreign Investment in the United States (CFIUS), the committee that manages the interagency process for monitoring foreign investments with a potential impact on national security. “The reform clarifies some ambiguities, and it incorporates CFIUS processes that had evolved over the last few years,” he said. “They did a very credible job.”
Later in the article, Crocker spoke of how interested parties would attempt to minimize the chances of an adverse CFIUS review in the wake of the reform. “You will continue to see defensive filings with CFIUS in those cases where people are not sure if there is a national security issue,” he said. “If you get your clearance letter from CFIUS, it’s like a vaccination certificate.”
