Craig Carpenito was quoted in a Law360 article discussing recent changes brought to the SEC’s Enforcement Division as a result of leadership and experience brought by former Department of Justice prosecutors. Carpenito discussed how it might be easier in this new climate for defense attorneys to stop investigations before they get going. “The perspectives of seasoned criminal lawyers at the top of the SEC’s Enforcement Division, who are acutely aware of what it takes to prove their cases at trial, will present opportunities for defense attorneys, under the right circumstances, to meet with the SEC in an effort to put an end to investigations before the SEC commits substantial resources to them and the investigations go public,” he said.
