Partners Examine Individual Prosecutions and Exclusions for the Washington Legal Foundation

The federal government is increasingly using strict-liability misdemeanor prosecutions of individual corporate officers and managers to punish and deter health care fraud, while also using those same legal theories to exclude the individuals and their corporate employers from federal health care programs.  Every in-house counsel and corporate officer in the industry should understand the risks involved, as well as the best practices for mitigating such risks.  Alston & Bird partners Mark Calloway and Brian Stimson examined this emerging issue in a presentation to the Washington Legal Foundation entitled “Liability & Exclusion Without Intent:  Managing to Survive Under the Responsible Corporate Officer Doctrine.”
