The federal government is increasingly using strict-liability misdemeanor prosecutions of individual corporate officers and managers to punish and deter health care fraud, while also using those same legal theories to exclude the individuals and their corporate employers from federal health care programs. Every in-house counsel and corporate officer in the industry should understand the risks involved, as well as the best practices for mitigating such risks.
