David Keating was quoted in Law360 discussing the COPPA parental consent verification and how the Federal Trade Commission recently rejected the first attempt under the amended COPPA Rule at proposing a parental consent safe harbor method.
“Given that data that is collected from children is one of the most sensitive categories of information, the commission is not going to take the approval of a new mechanism lightly and certainly won't do it where there is emerging technology that the commission seems to believe is not there yet, in terms of being able to determine if information is legitimate,” Keating said. “As social media and data analytics continue to advance and evolve, I would expect there would be more petitions and ideas brought forth,” he said.
