The U.S. Supreme Court removed oral arguments in Kingdomware Technologies, Inc. v. United States from its calendar, asking if the specific contract dispute has been resolved, thus rendering the suit moot.
Jeff Belkin, leader of Alston & Bird’s Government Contracts Group, said that cases in which a federal entity is continually making contested decisions may be able to skirt a mootness block.
By their very nature, small-business contracts are typically performed in a year or two, Belkin said.
“Well, no Supreme Court case will ever make it all the way up within a year or two,” he said.
