• Obtained a complete defense verdict after a seven-week jury trial against a national life insurance company for allegations of fraud and breach of fiduciary duty regarding annuity suitability and financial advice.
• Defeated class certification on a breach of fiduciary duty claim in a case involving investments in an alleged Ponzi scheme.
• Obtained dismissal on the pleadings in a RICO class action involving the sales and marketing of fixed indexed annuities, including the design and marketing of non-traditional index crediting options offered on those annuities.
• Secured dismissal of breach of fiduciary claims in life insurance matters pending in California and New York state courts.

Class Action and Data Privacy Matters

• Defending health care providers in class actions alleging invasions of privacy, CIPA, and CMIA.
• Obtained dismissal for lack of personal jurisdiction for a health care website facing CIPA and invasion of privacy claims.
• Represented a department store chain in a consumer protection action and defeated injunctive relief sought by the government.
• Obtained dismissal of a TCPA action against an insurance company.
• Obtained dismissal on the pleadings for an automotive manufacturer in a product defect class action.

Gillian H. Clow focuses her practice on complex litigation, including consumer class actions. She has experience in various industries, including life insurance, food and beverage, technology and retail, and cases involving claims of breach of contract, negligence, breach of fiduciary duty, RICO, fraud, unfair competition, and violations of Business & Professions Code Section 17200 and other tort claims. Gillian has been engaged by online retailers to represent them in class actions and arbitrations alleging data and privacy violations. She also defends companies facing California Consumer Privacy Act (CCPA), California Invasion of Privacy Act (CIPA), California Medical Information Act (CMIA), Video Privacy Protection Act (VPPA), and other privacy-related claims.

Gillian received her J.D. from Loyola Law School, Los Angeles, and was elected to the Order of the Coif. While in law school, Gillian served as an extern for the Hon. R. Gary Klausner of the U.S. District Court for the Central District of California and an editor of the Loyola of Los Angeles Entertainment Law Review. During the pandemic, Gillian was an active contributor to the “COVID-19 Litigation Roundup” for the Chamber Litigation Blog.

Gillian is actively involved in the firm’s pro bono and community service initiatives and is a member of the firm’s pro bono committee.
